The police have the power under the Crime and Security Act 2010 to issue a domestic violence protection notice this (DVPN) against an individual following their arrest at the police station and to apply to the local Magistrates Court for a domestic violence protection order (DVPO) if they believe it is ‘necessary’ to protect and ‘associated party’ from violence or the threat of violence.
The police will often apply for a DVPN in cases where a person is arrested and they decide either to take no further action against that person or decide to bail that person to return to the police station pending the outcome of a criminal investigation.

Should I bother contesting an application for a domestic violence protection order (DVPO)?
When the domestic violence protection notice is served on a person at a police station advising them of the date of hearing for the domestic violence protection order, the police will often indicate that the person doesn’t need to attend court.
